Welcome to Pocket Perfection! The terms “we”, “us”, and “our” refer to Pocket Perfection. Pocket Perfection operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Pocket Perfection is powered by Shopify, which enables us to provide the Services to you. The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province of residence and have given us consent to allow any of your minor dependants to use the Services on devices you own, purchase or manage. To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information such as your email address, billing, payment and shipping information. You represent and warrant that all information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online store. However, colours or product appearance may differ from how they appear on your screen due to your device type and display settings. We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be identical to images shown online. All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region or jurisdiction. Each Rivery Zero knife includes a complimentary lanyard and accessories. These items have no standalone purchase value unless otherwise specified.

SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. Pocket Perfection reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Pocket Perfection confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Pocket Perfection may be unable to accommodate cancellation requests after acceptance. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you using the contact details provided when the order was placed. Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will appear in your order confirmation email. Unless otherwise stated, prices include 15% VAT where applicable but exclude shipping, handling, customs or import charges. Prices listed in our online store may differ from prices offered elsewhere. Promotions may be governed by additional terms, which will prevail if inconsistent with these Terms. You agree to provide current, complete and accurate purchase and payment information for all purchases. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

SECTION 5 – SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Once products are handed to the carrier, title and risk of loss pass to you. Delivery within South Africa typically takes 2–5 working days, unless otherwise stated. International delivery times vary depending on destination and customs clearance.

SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Pocket Perfection, its affiliates or licensors and are protected by South African and international copyright, trademark and other intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Pocket Perfection’s names, logos, product and service names, designs, and slogans are trademarks of Pocket Perfection or its affiliates or licensors. You must not use such trademarks without prior written permission. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and designs on the Services are the trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. You acknowledge and agree that we provide access to such tools “as is” and “as available”, without any warranties or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion.

SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party websites or materials. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you decide to access third-party sites, you do so at your own risk. We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, or content from third-party sources.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Pocket Perfection is powered by Shopify, an e-commerce platform operated by Shopify Inc. (Canada). However, any sales and purchases made in our store are made directly with Pocket Perfection. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Pocket Perfection, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims and liabilities arising from your purchases and transactions with Pocket Perfection.

SECTION 10 – PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be processed by Shopify in accordance with Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services to provide and improve the Services. Information you submit will be transmitted to and shared with Shopify and relevant service providers, which may be located in other countries.

SECTION 11 – FEEDBACK
If you submit any ideas, suggestions, feedback, reviews, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback for any purpose, including commercial use. You represent and warrant that (i) you own or have all necessary rights to all Feedback; (ii) your Feedback complies with these Terms; and (iii) it will not violate any third-party rights or contain unlawful or malicious content.

Occasionally there may be information on the Services that contains typographical errors or inaccuracies relating to product descriptions, pricing or availability. We reserve the right to correct any errors or omissions and to change or update information or cancel orders if any information is inaccurate, at any time, without prior notice.

You may access and use the Services for lawful purposes only. You may not access or use the Services for: (a) any unlawful or malicious purpose; (b) to violate any South African or international laws or regulations; (c) to infringe upon or violate intellectual property rights; (d) to harass, abuse, defame, intimidate, or harm others; (e) to transmit false or misleading information; (f) to upload viruses or malicious code; (g) to send spam or other unauthorised promotions; or (h) to interfere with or circumvent the security features of the Services. We reserve the right to suspend or terminate your account without notice if you violate any of these prohibitions.

We may terminate this agreement or your access to the Services at any time without notice. You remain liable for all amounts due up to the termination date. Sections regarding intellectual property, limitation of liability, indemnification and governing law shall survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES
The Services and all products offered through the Services are provided “as is” and “as available” without any warranties or conditions of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by South African law, in no case shall Pocket Perfection, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or any products purchased through them.

SECTION 17 – PRODUCT USE AND LIABILITY DISCLAIMER
By purchasing from Pocket Perfection (a division of Inclusive Solutions Pty Ltd), you acknowledge that knives and other cutting tools are inherently sharp and must be handled responsibly. Pocket Perfection will not be liable for any injury, damage, or loss resulting from the use or misuse of any product. The Rivery Zero is a precision cutting tool and must be operated with care at all times. Customers confirm that they are of legal age and legally permitted to purchase, own, and use such products in South Africa. Pocket Perfection is the authorised South African dealer for Rivery Manufacturing and operates independently. Rivery Manufacturing bears no responsibility for any sales, distribution, or after-sales service provided by Pocket Perfection.

SECTION 18 – INDEMNIFICATION
You agree to indemnify and hold harmless Pocket Perfection, Shopify, and their affiliates, officers, directors, employees, agents, contractors, and service providers from any claims or demands, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party rights.

SECTION 19 – SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall be enforced to the maximum extent permitted, and the unenforceable portion shall be deemed severed. The remainder of the Terms shall remain valid.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT
The failure by us to enforce any right or provision shall not constitute a waiver of such right or provision. These Terms, together with our policies, constitute the entire agreement between you and Pocket Perfection regarding your use of the Services.

SECTION 21 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms without restriction.

SECTION 22 – GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa. You and Pocket Perfection consent to the non-exclusive jurisdiction of the South African courts.

SECTION 23 – HEADINGS
Headings are for convenience only and do not affect interpretation.

SECTION 24 – CHANGES TO TERMS OF SERVICE
We reserve the right, at our discretion, to update or replace any part of these Terms by posting changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
